Suganiya Sivabalan Wins Motion

Suganiya Sivabalan was successful in a motion last week. Our firm represented the defendants in an action that settled. Following the settlement, the plaintiff would not provide a release.

Earlier this year, we brought a motion to enforce the settlement and were successful. The plaintiff was ordered to provide the executed release, following which the settlement funds would be paid.

However, the plaintiff still did not provide the release. As a result, Suganiya sought an order to relieve the defendants from paying the settlement funds and to dismiss the action. The order was granted. Justice Tranquilli’s endorsement can be found here.
